Ontario’s Special Investigations Unit (SIU) has decided not to charge an Ontario Provincial Police officer involved in a highway crash last November that seriously injured two people.

The incident occurred on the northbound lanes of Highway 400 on Nov. 28, 2025, when a GMC Terrain lost power and stopped in a left lane about 50 metres north of the Highway 401 westbound off-ramp. The driver had turned on emergency flashers and stepped out to check the vehicle. Shortly after, a marked OPP cruiser collided with the stopped SUV, injuring the driver and a passenger, both of whom suffered multiple fractures.

SIU Director Joseph Martino said there were no reasonable grounds to believe the officer, who exercised his legal right not to be interviewed or release notes, committed a criminal offence. While the officer did not notice the stopped vehicle, other motorists were able to avoid it. The evidence suggested the collision was likely the result of a brief lapse in attention rather than reckless or negligent driving.

Martino noted the officer was travelling at safe speeds, in control of his cruiser, and had only seconds to react to the Terrain as he navigated the curve on the ramp. While the lapse contributed to the crash, the SIU concluded it did not meet the threshold for criminal charges.
